Terms of Service

These Terms of Service ("Terms") govern your use of the Aria mobile application and website (collectively, the "Service") operated by Aria ("we," "us," or "our"). By using Aria, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Aria. During account creation, we collect your date of birth to verify eligibility. Your date of birth is immutable once set and is never displayed publicly or included in public API responses. If you are under 18, you represent that you have your parent or guardian's consent. See our Children's Privacy (COPPA) policy for details on how we protect younger users.
2. Account Responsibility
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@aria-live.app if you suspect unauthorized access.
3. Content Ownership
Your content is yours. Creators retain full ownership of all audio content, session topics, and creative works shared on Aria. By using the Service, you grant Aria a limited, non-exclusive license to transmit, process, and store your content as necessary to operate the Service (e.g., streaming audio, generating AI summaries, moderating content).
4. Prohibited Content and Conduct
You agree not to:
- Post or transmit content that violates our Community Guidelines
- Harass, threaten, or intimidate other users
- Share hate speech, discriminatory content, or content promoting violence
- Post sexually explicit content or content involving minors
- Infringe on copyrights, trademarks, or other intellectual property rights
- Use Aria for illegal activities
- Record or redistribute session audio without consent of all participants
- Attempt to circumvent security measures, access controls, rate limits, or moderation systems
- Use bots, scrapers, or automated tools to access the Service
- Impersonate other users or Aria staff
- Publish personal information of others without consent (doxxing)
- Engage in coordinated harassment campaigns across sessions or accounts
- Spread health misinformation, financial fraud, or deceptive schemes (see Community Guidelines for details)
5. Creator Earnings
Creators who meet the monetization requirements may offer subscriber-only sessions. The earnings split, payment processing, and payout schedule will be as specified in the Creator Agreement when the monetization program launches. Aria may auto-pause billing after 30 days of creator inactivity. Detailed payment terms are provided in the Creator Agreement (available when you enable monetization).
6. Subscriptions
Subscriptions are billed monthly through web checkout. You may cancel at any time; access continues through the end of the billing period. Refunds are handled on a case-by-case basis in accordance with applicable law.
7. Recording
Stage sessions (Public Sessions and Subscriber Sessions) may be recorded. All speakers in recorded sessions are notified and must provide explicit consent; consent is logged with a timestamp for each participant. Listeners do not transmit audio and are not included in recordings. Recordings are retained for up to 90 days and are available for replay. Recording or redistributing session audio through external means (screen recording, external devices) is strictly prohibited. See our Recording Consent Policy for full details.
7.5. Recording Protection
To protect participants and creators, the Aria iOS app employs technical measures to detect and respond to external screen recording during live sessions. When screen recording is detected on a supported device, Aria displays a protective overlay and mutes session audio to prevent unauthorized capture. These measures are designed to uphold the external recording prohibition described in Section 7 and our Recording Consent Policy. Recording protection capabilities may vary by platform and device.
8. AI Features
Aria uses AI to generate session summaries, provide live captions, and assist with content moderation. AI-powered safety features include:
- Real-time audio moderation: Live sessions are monitored by AI for harmful content
- DM toxicity screening: Direct messages are screened for toxic or harassing content
- PII detection: Personal information shared in audio (phone numbers, addresses) is flagged for review
- Content warnings: AI may automatically flag sessions that contain mature themes
AI-generated content is provided "as-is" and may contain inaccuracies. AI features process audio and text data as described in our Privacy Policy.
9. Moderation and Enforcement
Aria reserves the right to moderate content and enforce these Terms and Community Guidelines. Enforcement actions may include warnings, temporary suspensions, permanent bans, and content removal. If you believe an enforcement action was taken in error, see the Appeals Process.
9.5. Audit and Transparency
Aria maintains an internal moderation audit log. All enforcement actions are recorded with the specific violation, the action taken, and an explanation. If you are subject to an enforcement action, you will receive a notification explaining what happened and why. Appeal information is included with every enforcement notification (see Appeals Process).
10. Termination
You may delete your account at any time through Profile → Settings → Delete Account. We may suspend or terminate your account for violations of these Terms or Community Guidelines. Upon termination, your right to use the Service ceases immediately.
When your account is deleted or terminated:
- Your profile, connections, and session data are permanently removed
- Active subscriptions (as subscriber or creator) are canceled and prorated refunds are issued where applicable
- Moderation audit records are retained as required for legal compliance
- An account deletion audit record is created and retained for legal compliance
11. Disclaimers
The Service is provided "as-is" and "as available." We make no warranties, express or implied, regarding the Service's reliability, accuracy, or availability. We are not responsible for user-generated content, third-party services, or interruptions to the Service.
12. Limitation of Liability
To the maximum extent permitted by law, Aria's total liability for any claims arising from your use of the Service is limited to the amount you paid to Aria in the 12 months preceding the claim, or $100, whichever is greater.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of Aria after changes constitutes acceptance of the updated Terms.
14. Creator and Subscriber Agreements
If you enable monetization, the Creator Agreement applies in addition to these Terms. If you subscribe to a creator, the Subscriber Agreement applies in addition to these Terms. In the event of a conflict between these Terms and a supplemental agreement, the supplemental agreement controls for matters within its scope.
