DMCA Policy

Aria respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). This policy describes how to report copyright infringement and how we handle such reports.

1. Designated Agent

Aria's designated agent for receiving DMCA notices per 37 C.F.R. § 201.38:

Note: Aria is in the process of registering its designated agent with the U.S. Copyright Office. In the interim, all DMCA notices should be sent to the email address above.

2. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been used on Aria without authorization, you can file a notice through either channel:

  • In-app: Navigate to Profile → Safety → DMCA Notice and follow the guided form
  • Email: Send a written notice to our designated agent at the email above

Your notice must contain:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material on Aria that is allegedly infringing, with enough detail for us to locate it (e.g., session ID, username, date/time)
  4. Your contact information (name, address, phone number, email)
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

3. Processing Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Disable recording for the affected session (if applicable)
  • Add a copyright strike to the user's account (see Repeat Infringer Policy)
  • Notify the user who posted the content
  • Log the action in the moderation audit trail
  • Provide the user an opportunity to submit a counter-notification

4. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification through the in-app form (Profile → Safety → Counter-Notification) or by sending a written notice to our designated agent containing:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, and phone number
  5. A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which Aria may be found)
  6. A statement that you will accept service of process from the person who filed the original notice

5. Content Restoration

If we receive a valid counter-notification and the original complainant does not file a court action within 14 business days, the content is automatically restored and the associated copyright strike is removed from the user's account. The original complainant is notified before content is restored.

6. Repeat Infringer Policy

Aria maintains a three-strike policy for repeat copyright infringers as required by DMCA §512(i). For full details including what counts as a strike, strike expiration, counter-notification effects, and creator-specific consequences, see our Repeat Infringer Policy.

7. Good Faith

Filing a false DMCA notice is a violation of federal law. If you knowingly misrepresent that material is infringing, you may be liable for damages, including costs and attorneys' fees.

8. Live Audio

Because Aria primarily hosts live audio, most content is ephemeral. For live sessions, we may take action by muting or removing participants who are playing copyrighted material during a session. For recorded sessions, we follow the standard takedown process described above.

Aria uses ACRCloud audio fingerprinting to detect unauthorized copyrighted music in recorded sessions. When a match is detected, it is logged for review. Creators are responsible for obtaining appropriate licenses for any music played during their sessions.
